Legal information about selling your clothing on a commission basis:
1.Item and warranty
a) The commission agent (m/f/d) is responsible for selling the goods/commission goods (e.g. clothing) specified in the list for the principal (m/f/d). b) b) The sale can take place in the retail store and/or in the commission agent's online shop; -Feel Again- decides this at its own discretion.
c) The principal (m/f/d) assures that he is the unrestricted owner of the commission goods listed in the list.
2. Contract duration
a) The commission contract is concluded for a period of 2 months from the signing of the contract and the handover of the goods, as long as this is not expressly extended in writing.
b) After termination of the contract, the commission agent (m/f/d) must hand over the commission goods still in his possession to the principal (m/f/d).
c) If the goods are not sold after this date, the customer will be given one month to collect them. The goods are then donated to social projects in Gelsenkirchen.
3. Property, Liability & Insurance
a) The goods remain the exclusive property of the client (m/f/d) until sold.
b) The commission agent (m/f/d) is only liable for the care he takes in his own affairs.
c) There is an obligation to insure the commission goods by -Feel Again-
not.
d) The customer (m/f/d) assures that the listed goods are not stolen goods or a deliberate brand counterfeit.
4. Compensation
a) The commission agent (m/f/d) receives commission
- 30% of the gross sales price if he has it paid out in cash - 40% of the gross sales price if he has it paid out as a shopping voucher - always 40% of the gross sales price if he is a student under the age of 25 and this is proven by proof has.
b) The principal share will be paid out upon agreement, but no later than the end of the contract period.
5. Image rights
a) In order to increase sales success, the commission agent (m/f/d) can take pictures of the goods in order to publish them on the Internet.
6. Severability clause
a) If a contractual provision is void, ineffective or incomplete, this will not affect the effectiveness of the remaining provisions of the contract
